# HMRC Letter About eBay, Vinted or Airbnb Income? What To Do Next

A letter from [HM Revenue & Customs](https://lexlaw.co.uk/hmrc-tax-dispute-lawyers/) about your online marketplace activity is unsettling, especially if you treat the selling or letting as a hobby rather than a business. Since 1 January 2024, under the [Platform Operators (Due Diligence and Reporting Requirements) Regulations 2023 (SI 2023/817)](https://www.legislation.gov.uk/uksi/2023/817/contents), eBay, Vinted, Etsy, Depop, Amazon, Airbnb and similar platforms must report seller data to [HMRC](https://lexlaw.co.uk/hmrc-tax-dispute-lawyers/) annually. It is cross-matched against Self Assessment and PAYE records at scale, and letters follow where the figures do not match.

Receiving one does not mean you owe tax. It means your position is now visible to HMRC, and your response or your silence shapes everything that follows. Our [HMRC tax dispute solicitors and barristers](https://taxdisputes.co.uk/) act at precisely this stage, where early strategy decides whether a matter closes quietly or becomes a full investigation.

## Why HMRC Has Written To You About Your Online Income

A platform must report any seller who, in a calendar year, completes 30 or more sales of goods or receives consideration exceeding roughly £1,700 (EUR 2,000); accommodation platforms such as Airbnb report regardless of volume. The data covers your identity details, gross amounts credited, fees deducted and transaction count.

[HMRC](https://lexlaw.co.uk/hmrc-tax-dispute-lawyers/) writes in batches "one to many" letters so selection means you fall within a risk profile, not that you have been individually investigated. Critically, HMRC holds gross receipts only: nothing for the cost of the goods, platform fees, postage, or the fact that you may have been selling your own possessions at a loss.

## What Type Of HMRC Letter Have You Received?

Four categories differ materially in law:

- **Nudge letter (one to many):** an invitation to check and correct your position, usually with 30 days to reply. No obligation to respond but ignoring one is the commonest route into a formal enquiry.

- **Notice of enquiry (s.9A TMA 1970):** a formal enquiry into a filed return, with defined powers on HMRC’s side and defined rights on yours.

- **Information notice (Schedule 36, Finance Act 2008):** a binding demand for documents, backed by penalties. Its scope can and often should be challenged.

- **Code of Practice 9 (Contractual Disclosure Facility):** issued where HMRC suspects deliberate conduct, with a 60-day deadline. Obtain [specialist COP9 legal advice](https://taxdisputes.co.uk/tax-evasion-hmrc-code-practice-9-investigations/) before responding.

If you are unsure which you have, our [HMRC tax investigation solicitors](https://taxdisputes.co.uk/hmrc-tax-investigations-solicitors-london/) will review the correspondence and advise within days.

## Is Your eBay, Vinted Or Airbnb Income Actually Taxable?

### Selling Your Own Possessions

Clearing a wardrobe on Vinted or selling unwanted household items is not trading. Disposing of personal chattels is a capital matter, and under [section 262 of the Taxation of Chargeable Gains Act 1992](https://www.legislation.gov.uk/ukpga/1992/12/section/262) gains on tangible moveable property are exempt where consideration does not exceed £6,000 per item and most second-hand goods sell for less than they cost, so there is no gain at all. The difficulty is evidential, not legal: HMRC sees a gross figure, and you must explain it.

### When Online Selling Becomes Trading

Whether an activity is a trade is a question of fact judged against the "badges of trade". In [*Marson v Morton* [1986] STC 463](https://lawprof.co/tax/self-employment-taxes-cases/marson-v-morton-1986-stc-463/), Sir Nicolas Browne-Wilkinson V-C set out a non-exhaustive list of factors, stressing that no single badge is decisive. Even a one-off can qualify: in [*Rutledge v IRC* (1929) 14 TC 490](https://lawprof.co/tax/self-employment-taxes-cases/rutledge-v-irc-1929-14-tc-490/) a single purchase of one million toilet rolls for resale was an adventure in the nature of trade, as was the financed bullion purchase in [*Wisdom v Chamberlain* [1969] 1 WLR 275](https://www.casemine.com/judgement/in/5d4a60583321bc5f0d3896bd). Buying stock to resell, repetition and organisation point to a trade; selling personal or inherited items does not.

If you are trading, the £1,000 trading allowance (s.783A ITTOIA 2005) applies to *gross* receipts, not profit. Exceed it and you must notify chargeability under s.7 TMA 1970 by 5 October following the tax year. [The Self Assessment](https://lexlaw.co.uk/solicitors-london/category/tax-law/) reporting threshold is due to rise to £3,000 gross during this Parliament, but the allowance itself is unchanged and tax remains due above it.

### Airbnb And Short-Term Lettings

Letting furnished accommodation in your only or main residence may attract Rent a Room relief of £7,500 per tax year. A separate property does not qualify; there the £1,000 property allowance may apply instead, and the two cannot be combined. The Furnished Holiday Lettings regime was also abolished from 6 April 2025, so short-term letting income is now taxed as ordinary property income, with finance costs restricted to a basic-rate tax reduction only.

## How Far Back Can HMRC Go?

The ordinary window is four years from the end of the tax year ([s.34 TMA 1970](https://www.legislation.gov.uk/ukpga/1970/9/section/34)), extending to six where tax is lost carelessly and twenty where it is lost deliberately or chargeability was never notified (s.36). Where no return was filed, HMRC proceeds by discovery assessment under s.29.

These extensions are not automatic. In [*HMRC v Tooth* [2021] UKSC 17](https://supremecourt.uk/cases/uksc-2019-0136) the Supreme Court held that a deliberate inaccuracy requires an intention to mislead a demanding test HMRC does not always meet. In [*Burgess and Brimheath Developments Ltd v HMRC* [2015] UKUT 578 (TCC)](https://www.gov.uk/tax-and-chancery-tribunal-decisions/1-michael-burgess-2-brimheath-developments-limited-v-the-commissioners-for-hm-revenue-and-customs-2015-ukut-0578-tcc) the Upper Tribunal confirmed that the burden of establishing a valid discovery assessment, including any extended time limit, rests on HMRC. Argued properly, these points often cut the years in scope and the sums at stake.

## Penalties: What Is Genuinely At Risk

Understated tax is penalised under [Schedule 24 Finance Act 2007](https://www.legislation.gov.uk/ukpga/2007/11/schedule/24/enacted); failure to notify chargeability under Schedule 41 Finance Act 2008. Both are behaviour-based:

- **Careless:** up to 30% of the potential lost revenue.

- **Deliberate:** 20% to 70%.

- **Deliberate and concealed:** 30% to 100%, higher offshore.

The minimum depends on whether disclosure is *unprompted* and on your co-operation telling, helping, giving access. An unprompted disclosure of a careless failure to notify can attract a nil penalty, so delay costs money. A reasonable excuse may defeat a penalty entirely; *Perrin v HMRC* [2018] UKUT 156 (TCC) sets out the four-stage approach a Tribunal must take. Our [HMRC penalty appeal solicitors](https://taxdisputes.co.uk/hmrc-penalties/) obtain reductions and cancellations on exactly these grounds.

## What You Should Do On Receipt Of The Letter

- **Do not ignore it**: HMRC has warned that non-responders can expect a compliance check. Silence turns a soft enquiry into a formal one and forfeits the best penalty position.

- **Do not telephone HMRC to explain**: Unscripted answers are recorded and hard to retract.

- **Gather your records**: Platform seller report, bank and PayPal statements, purchase receipts and postage records for each year in question.

- **Settle your legal position before disclosing**: Whether you traded, which allowances apply and which years are in scope come first; the wrong basis is hard to undo.

- **Choose the right disclosure route**: The Digital Disclosure Service suits non-deliberate errors; where conduct may be deliberate, the Contractual Disclosure Facility offers protection from prosecution that the DDS does not. Our [HMRC voluntary disclosure solicitors](https://taxdisputes.co.uk/hmrc-voluntary-disclosure-campaigns-solicitors-london/) advise on this choice daily.

## Why You Should Not Rely On Your Accountant Alone

Communications with an accountant are not covered by legal professional privilege and can be compelled under a Schedule 36 notice; communications with solicitors and barristers are privileged. Where [HMRC](https://lexlaw.co.uk/hmrc-tax-dispute-lawyers/) may allege deliberate behaviour that distinction is decisive, which is why we are routinely instructed to engage a forensic accountant for the client, bringing that work within privilege. Where an adviser’s failings caused the problem, we can also advise on a [professional negligence claim against an accountant](https://professionalnegligenceclaimsolicitors.co.uk/).

## If Matters Escalate: Appeals, Tribunal And Enforcement

If HMRC issues an assessment or penalty you dispute, you generally have 30 days to appeal. You may request an [HMRC internal review](https://taxdisputes.co.uk/hmrc-internal-review-appeals-solicitors-london/) or notify the appeal to the [First-tier Tax Tribunal](https://taxdisputes.co.uk/first-tier-tax-tribunal-solicitors-london/). If the deadline has passed, permission can still be sought: we regularly act on [late appeals to the Tax Tribunal](https://taxdisputes.co.uk/late-hmrc-tax-appeals/).

Unpaid assessments attract enforcement: HMRC may issue a [statutory demand](https://taxdisputes.co.uk/hmrc-statutory-demand/) or, against a company, present a [winding-up petition](https://windinguppetitionsolicitors.co.uk/), which can freeze bank accounts from the moment it is advertised.

### Frequently Asked Questions (FAQ's)

Why have I received an HMRC letter about eBay or Vinted sales?
HMRC may have received information about your online sales from a digital platform and compared it with your tax records. A discrepancy or activity that warrants further checking may prompt a letter. Receiving one does not automatically mean that you owe tax or have committed a tax offence.

Do I have to pay tax on selling personal belongings on eBay or Vinted?
Not necessarily. Selling unwanted personal possessions is generally different from trading for profit. Capital Gains Tax may apply to certain personal possessions if they are sold at a gain, subject to the applicable rules and exemptions. If you regularly buy goods to resell for profit, your activity may instead constitute a trade. The circumstances of each case matter.

What is the £1,000 trading allowance, and does it mean I do not need to declare my income?
The £1,000 trading allowance can exempt qualifying gross trading income from tax, subject to the relevant conditions. It is based on gross income rather than profit. Whether you need to notify HMRC or complete a Self Assessment tax return depends on your circumstances and the applicable reporting rules. The allowance does not automatically remove every reporting obligation.

What should I do if HMRC sends me a letter about undeclared online income?
Read the letter carefully, identify whether it is an informal nudge or a formal notice, and check any response deadline. Gather platform statements, bank records, purchase receipts and evidence of the items sold. Before making a disclosure or giving a detailed explanation, establish whether the activity was taxable and which tax years are involved. [Specialist advice ](https://lexlaw.co.uk/contact-us/)may be particularly important if HMRC suspects deliberate behaviour

Can HMRC charge penalties for undeclared eBay, Vinted or Airbnb income?
Yes, where tax was underpaid or a notification obligation was missed and the relevant penalty conditions are met. The amount depends on factors including the type of failure, whether the behaviour was careless or deliberate, and the quality and timing of any disclosure. Reasonable excuse provisions and reductions for disclosure may also be relevant. A penalty is not automatic simply because a platform reported your activity.
